This Acceptable Use Policy (this "Policy") governs use of the services provided by Next Path Software Consulting Inc. DBA Metered ("Metered"). It forms part of the agreement under which Metered provides those services. Capitalised terms not defined here have the meaning given in that agreement.
Customer is responsible for its own use of the services and for use by its end users, and must ensure that both comply with this Policy.
Prohibited uses include, without limitation, using the services to transmit, store or facilitate:
- any activity that is unlawful in any jurisdiction in which the services are used, or that facilitates unlawful activity;
- material that infringes the intellectual property, privacy or other rights of any person;
- material depicting the sexual exploitation or abuse of children;
- material that is defamatory, harassing, or that promotes violence or discrimination against any person or group;
- malware, ransomware, or any code intended to damage, disrupt or gain unauthorised access to any system; or
- unsolicited bulk communications, or communications sent in breach of applicable anti-spam law.
Prohibited uses also include, without limitation:
- using the services as an open or anonymising proxy, or to conceal the origin of traffic for the purpose of evading attribution, filtering or lawful process;
- relaying traffic that forms part of a denial-of-service attack, port or vulnerability scanning, credential stuffing, brute-force attempts, or any other attack against a third party;
- attempting to circumvent quotas, rate limits, bandwidth allowances, authentication or any other technical control;
- sharing, publishing or reselling credentials or API keys issued to Customer, or permitting their use other than through Customer's own products and services;
- probing, scanning or penetration-testing Metered's infrastructure without Metered's prior written consent;
- interfering with, degrading, or placing an unreasonable burden on the services, on Metered's infrastructure, or on any other customer's use of them;
- reverse engineering, decompiling or attempting to derive the source code or underlying structure of the services, except to the extent applicable law prohibits that restriction; or
- any other use that Metered reasonably determines presents a risk to the security, integrity or availability of the services, to Metered's infrastructure, or to any other customer's use of them.
Customer must:
- protect credentials and API keys issued to it, and rotate them promptly on suspected exposure;
- configure its applications in accordance with the Documentation;
- ensure its end users comply with this Policy; and
- report any suspected compromise, misuse or abuse of the services to Metered promptly.
Metered may investigate suspected breaches of this Policy and may suspend or restrict access to the services in accordance with the applicable agreement. Where a breach presents a risk to the security, integrity or availability of the services, or to any third party, Metered may suspend access immediately and will notify Customer promptly.
Repeated or serious breach of this Policy is a material breach of the applicable agreement.
Metered may report unlawful activity to law enforcement or other competent authorities, and may disclose information to the extent required to do so.
No period of suspension imposed under this Policy constitutes downtime under any service level agreement, and no service level credit is payable in respect of it.
Metered may update this Policy from time to time. Where a change materially increases Customer's obligations, Metered will give at least thirty (30) days' notice before it takes effect. Each version carries an effective date.
